Understanding the 90-Day Waiting Period in Oklahoma Divorce
Did you just file for divorce, and now you have to wait 3 months to get separated? Hi, I’m Tahlequah family attorney Aaron Grubb at Wirth Law Office, and in this video, we’re going to discuss why the court requires a 90-day waiting period before finalizing a divorce in Oklahoma.
In Oklahoma and many other states, the court wants to give couples time to reconsider. They understand that divorce petitions can sometimes be filed in the heat of the moment, driven by temporary anger or frustration, or even used to gain an advantage in the relationship.
The Purpose of the Waiting Period
The 90-day waiting period is designed to give the couple time to think things over before the divorce is finalized. This waiting period is especially important if the couple has children. For couples without children, the waiting period is much shorter—just 10 days.
However, for couples with kids, the 90-day waiting period is much longer because the court places a strong emphasis on maintaining a two-parent household when possible for the sake of the children. This approach is intended to ensure that parents are making informed decisions that will affect their children’s lives.
