Understanding the Steps After Paternity is Established

First off, the court’s going to order a TO, which is just a temporary order that establishes custody, visitation, and child support during the pendency of the action. While the action is taking place, they want something in place so that the child is being cared for. Both parents will receive some visitation and custody rights just during the pendency of the action.
Best Interest of the Child Analysis
Second, when the court determines the custody issue, they’re going to conduct what’s called the best interest of the child analysis. This process looks at various factors, including which parent provides a more stable environment and who has more resources to support the child. They’ll also consider which parent has a more flexible work schedule that allows for more time spent with the child.
Lastly, if you’re going through a DHS administrative court proceeding, which is different from a county court paternity action, they can also establish custody and visitation. This is a critical step that needs to be addressed in a county court to ensure that all rights and responsibilities are sorted out properly.
