When a judge is deciding custody, they’re focused on one thing: the best interest of the child. With that in mind, here are some behaviors or attitudes that may negatively affect your case:
Key Behaviors to Avoid
1. A Rigid, Know-It-All Mindset
If you approach the case with a strict, uncompromising attitude—saying things like, “This is the way I was raised,” or “I know what’s best and no one else does”—that can work against you. Even if you are right, coming across as unwilling to compromise may concern the judge.
Judges look for co-parents who can work together. If you appear difficult or inflexible, the court may lean toward granting more time—or even primary custody—to the parent who seems more cooperative.
2. Lack of Involvement in the Child’s Life
Another major red flag is being uninformed or uninvolved. If you can’t name your child’s:

- Teacher or coach
—then it shows a lack of engagement.
You should be able to explain who these individuals are and what role they play in your child’s life. Saying things like, “The mom always takes them to soccer, I just show up for the game and leave,” does not reflect well on your parenting role. Judges want to see that you’re actively involved in all aspects of your child’s upbringing.
