Special judges are created by statute—meaning their role and authority come from laws passed by the Oklahoma Legislature. They operate below the level of district judges and are authorized to handle certain types of cases within clearly defined limits.
Types of Cases Special Judges Handle
Here are a few examples of the types of cases special judges can hear:
1. Civil Actions Involving Small Monetary Claims
Special judges can preside over cases where the amount claimed is $10,000 or less, and where counterclaims do not exceed $1,000. These are often small claims cases or lower-value breach of contract disputes.
2. Minor Misdemeanors
They can also hear misdemeanors that carry no more than a $200 fine or up to 30 days in the county jail. These are typically lower-level criminal offenses.
3. DUI Cases
Special judges are also allowed to preside over first-time DUI offenses, which are classified as misdemeanors in Oklahoma. While second DUIs may sometimes elevate in seriousness, first-time offenses often fall under a special judge’s jurisdiction.
