Understanding the Next Steps After an Arrest
If you’ve recently been arrested or charged with a crime and are unsure of what comes next, I’m here to help. Hi, I’m Tahlequah criminal attorney Aaron Grubb at Wirth Law Office, and in this video, we’re going to break down the criminal process.
The process can vary depending on the county. Some counties move quickly and resolve cases faster, while others may take longer due to larger caseloads. But in general, every criminal case starts with an arraignment. During this hearing, you’ll enter a guilty or not guilty plea, and the judge will discuss the next steps, such as setting a date for future hearings.
What Happens During the Arraignment?
If you choose to plead guilty and want a quicker resolution, the judge might skip certain steps, like a preliminary hearing, and proceed directly to sentencing. However, if you plead not guilty, the process continues with more steps, such as an Allen hearing (if we request discovery from the state) and a preliminary hearing, where the state must show there’s enough evidence to move forward with the case.
If the case proceeds, it may end in a jury trial. This is a simplified version of the criminal process in Oklahoma, but depending on the specifics of the case, there could be additional steps. If you’re facing a criminal charge, don’t hesitate to reach out.
