Understanding Firearm Definitions in Oklahoma
What Is the Legal Definition of a Firearm in Oklahoma? Hi, my name is Aaron Grubb. I’m the Tahlequah felony attorney at Wirth Law Office. In this video, we’re going to talk about the Oklahoma statutory definition of a firearm.
The Importance of Legal Definitions
If you’ve been charged with illegal possession of a firearm—whether as a felon, a minor, or under another restriction—it’s crucial to examine every possible defense. One such defense may lie in the legal definition of the firearm itself.
According to Oklahoma jury instruction CR 6-45, a firearm is defined as:
“A weapon from which a shot or projectile is discharged by force of a chemical explosion such as gunpowder.”
Clarifying Misunderstandings
This definition is important because devices like airsoft guns, BB guns, or CO₂-powered air pistols do not meet the legal definition of a firearm in Oklahoma. So, if you were arrested with one of these types of weapons, you may have a valid argument that you weren’t in possession of an actual firearm under state law.
