Understanding Your Probationary Period
So you’re on probation and you’ve got a couple of questions, but when should I do these probationary classes? When can I pay the fees? That sort of stuff. I’m Tahlequah Probation Violation Attorney Aaron Grubb at Wirth Law Office. In this video, we’re just going to talk about the probationary period and what you should be doing.
During this probationary period or deferred sentence, you have certain requirements that must be accomplished by your review date. If these requirements are not met, the state can withdraw the plea deal and reinstate the original charges against you. It is crucial to fulfill your probationary obligations to avoid invoking the wrath of the state.
Consequences of Non-compliance
For example, we had a client who was diligently attending all his probationary classes but had one additional course linked to a program he was not enrolled in. When we reached the review hearing, it became apparent that he hadn’t enrolled in this mandatory class. As a result, the state initiated procedures to accelerate the case, meaning they would withdraw the plea deal and file the original charges against him for non-compliance.
However, there was a silver lining in this situation. We were racing against time to get him enrolled in the required classes and had a set deadline. On the day of his review hearing, a snowstorm occurred in Tulsa, which closed the courtroom. This unexpected event provided him with the extra time needed to enroll, demonstrate compliance, and ultimately led to the dismissal of the application to revoke.
